    Today my car got hit by a guy and messed it up. The guy that hit it tried to run away but he was to hurt.. He doesn't have insurance and I have regular not full cover insurance..

    He was in the hospital and he is now in jail..

    What should I do.. for the damages

    My mom was driving it. (i was in school)
    She is ok

    your going to have to sue him, but your pretty much screwed if you ask me. Really sorry to hear this happened. I got in a wreck one time without insurance, I was on my way to get insurance and I got hit straight on by an illegal immigrant without insurance. I still took the time to fix his car for him because I knew how. I would try to talk to the guy and give him a second chance, maybe he'll do the right thing now that he knows he'll get sued if he dose not, but I don't know I might just sue him right off.

    wait for him to get out of jail n put him back in the hospital lol this wont recoup any losses but at least u can have fun for a few minutes lol

    I'd sue him in small claims court and follow through. Just so that, if nothing else, if he ever does have money, there'll be a lien for you in place.

    You never know though. I remember one time being in a similar situation (I was living at home and it was my parents actually) and the guy w/no insurance ended up giving my dad a Johnson outboard boat motor thing to call it even...

    IMO, if you can't afford to pay out to replace your vehicle, you ought to carry full coverage - or if your state offers one of those 'uninsured driver' add-ons. It's one of those times it costs more to not have coverage than it does to pay the higher premium.

    Does Texas have (uninsured driver) add ons?
    and would the regular insurence have it?
