    I actually think its a pretty crappy law since the cops most likely won't catch the guy unless he is a repeater.

    My solution will be to get a lot of dogs.

    no thats just peoples opinion. you can pull up the laws of your state. written by your state on your states official web site. not opinion's of others.

    Whoever said NO in the arguement would be correct if it pertains to your state. You cannot shoot an unarmed man who is stealing your property outside your house. You can't kill or seriously injure a person merely to protect property in the state of IN. In Texas it's another story. He has to be presenting a credible threat to your life or personal safety.

    You would be both criminally and civilly liable. If he was in your house and you did not invite him in, then you would be cleared of criminal charges, but could still face a civil suit. If you were in the car during the time he tried to break into that car then you can use your weapon.

    You are allowed to use "reasonable force" to protect property, but not deadly force. You could point the firearm at the person because you have proof they are stealing your stuff, but you cannot shoot a person to protect property. If you draw a gun tell him to stop and he keeps stealing your stuff, but poses no physical threat to you then you can't do a darn thing with that gun.

    You could however taser or pepper spray the crap out of him. You can use "reasonable force" to stop the crime in progress. If you do end up shooting you better go back inside and grab a steak knife and put it in the guy's hand you just shot before you call the cops.

    lol, ok now for all of you that say yes, if you were faced in a situation where someone broke in with a gun, could you really shoot them?

    If they were able or tried to harm myself, my girlfriend, friends, or family, or my tank in any way, without a doubt yes.

    I know an old guy who shot a kid (17) here in WV for breaking in. The kid had a gun and, without hesitation, the old man shot the kid. The cops didn't do much of an investigation considering the kid and his family were all crack addicts.

    I would never go to Jersey or a few other states with a rifle. I think Jersey is auto 5 years for a concealed weapon. Make sure you check the laws of the states you will be driving through if you carry.

    Broke into your house and they had a gun? Yes, you can shoot to kill legally in most, if not all, states. You would be cleared of all criminal charges. You could however still be sued by the victims family in civil court. Remember a shotgun has more effective close quarters stopping power than a handgun. A shotgun is just point and pull the trigger, no aiming. If he was in my house and armed, gun or knife or baseball bat, then yes the last thing he would ever see is my shotgun.

    If they had a gun, yes automatically. This is actually how a lot of cops get shot in boched no-knock warrant situations.

    with out a gun:
    If they attacked me, or destroyed something I had worked years for. But upon the considering this thread I may buy a taser for petty situations.
