Would it matter or hurt anything if I laid my return pump on its side? I figure that I could use the suction cup base and attach it to the side wall of the sump tank to hold it in place and keep it from vibrating. I figure that way my water level can drop a little lower in the sump tank during those days when I loose a little more to evaporation. (Yea I know I need to get an auto top off system in place!)

It "shouldn't" be an issue though it may also depend on the type of pump you have.

As long as the intake is not blocked or restricted, it will be fine.

It will be fine, many pumps have brackets or feet that will attach all sorts of ways.
